1. Acceptance of Terms

By downloading, installing, or using the BaldingAI app ("App") or visiting hairlosstracker.app ("Site"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App or Site. These Terms apply to all visitors, users, and others who access or use the service.

2. Description of Service

BaldingAI provides a personal hair loss tracking application that allows users to:

• Photograph and log hair loss progress over time
• Receive AI-generated scoring across density, thickness, scalp coverage, and hairline metrics
• Review month-by-month trends and generate progress summaries
• Export data for use in healthcare provider consultations

The service is intended solely for personal, non-commercial tracking purposes. It is not a substitute for professional medical evaluation or treatment.

3. Not Medical Advice

The App generates AI-assisted scores and trend data based on photos you submit. These scores are informational and for personal tracking only. They do not constitute:

• A medical diagnosis of any condition
• A recommendation to start, stop, or change any treatment
• A substitute for advice from a licensed healthcare professional
• Clinical or dermatological assessment

If you have concerns about your health, hair loss severity, or treatment response, consult a qualified physician or dermatologist promptly.

4. Eligibility

You must be at least 13 years old to use the App. By using the App, you represent that you are at least 13 years of age. Users under 18 should use the App only with parental or guardian supervision. We do not knowingly collect information from children under 13.

5. User Accounts

When you create an account, you are responsible for:

• Maintaining the confidentiality of your login credentials
• All activity that occurs under your account
• Providing accurate and up-to-date information
• Notifying us immediately of any unauthorized access

We reserve the right to terminate accounts that violate these Terms or engage in misuse of the service.

6. Acceptable Use

You agree not to:

• Use the App for any unlawful or fraudulent purpose
• Upload photos of third parties without their explicit consent
• Attempt to reverse-engineer, scrape, or compromise the App or its AI systems
• Misrepresent your identity or create accounts on behalf of others without authorization
• Use the service to distribute spam, malware, or harmful content
• Circumvent any technical measures we use to limit access to the App

7. Intellectual Property

All content on the Site and App — including text, graphics, logos, AI models, and software — is the property of Balding AI or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our express written permission. Your personal tracking data and photos remain yours; you grant us a limited license to process them solely to provide the service.

8. Subscription and Billing

Certain features of the App may require a paid subscription. If you purchase a subscription:

• Payments are processed through the Apple App Store or Google Play Store
• Subscriptions auto-renew unless cancelled at least 24 hours before the renewal date
• Refunds are handled according to the applicable platform store policies
• We reserve the right to change pricing with reasonable notice

9. Disclaimer of Warranties

The App and Site are provided on an "as is" and "as available" basis without warranties of any kind, express or implied. To the fullest extent permitted by law, Balding AI disclaims all warranties including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. AI-generated scores are estimates and may not reflect clinical reality.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Balding AI and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of (or inability to use) the App or Site, including any damages resulting from reliance on tracking data or AI-generated scores in making healthcare decisions. Our total liability to you for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Balding AI and its affiliates from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the App, your violation of these Terms, or your infringement of any third-party rights.

12. Third-Party Links and Services

The App and Site may contain links to third-party websites or services. We are not responsible for the content, privacy practices, or accuracy of any third-party sites. Links do not imply endorsement. Use third-party services at your own risk.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States, without regard to conflict-of-law principles. Any disputes arising under these Terms shall be resolved through binding arbitration or in the courts of competent jurisdiction.

14. Changes to These Terms

We may update these Terms periodically. We will notify you of significant changes through the App or by updating the "Last updated" date above. Continued use of the App after changes constitutes acceptance of the revised Terms. If you disagree with the updated Terms, you should stop using the App and delete your account.
